What is art licensing?
Art licensing is granting permission for my artwork to be used by another individual, company, or organization on their products, packaging, or marketing materials.
How does art licensing work?
I’m glad you asked! Here are the steps:
- You (the licensee) pick something you love from my portfolio.
- We negotiate the terms of the Licensing Agreement (contract), such as how long you can use it, what you’re using it for, and how much you’ll pay.
- We sign the contract.
- You use my art.
- I (the licensor) get paid.
- We both celebrate. Your brand gets great visuals without creating the art yourself. I get to continue creating, and more beauty is out into the world through our collaboration.
What types of products can your artwork be used on?
There are a plethora of uses for my art. Here are some suggestions:
- Home Decor: Bedding, wallpaper, throw pillows, curtains, rugs, wall art, textiles, etc.
- Apparel: T-shirts, scarves, shoes, baby and kids, dresses, etc.
- Stationery: Greeting cards, notebooks, journals, stickers, etc.
- Branding: Logos, packaging, ads, etc.
- Merchandise: Phone cases, mugs, puzzles, candles, etc.
What is covered in an art licensing agreement?
The licensing agreement is our official contract, and it covers the following:
- Payment Terms: Royalties or Flat Fee
- License Duration
- Exclusivity: Exclusive or Non-exclusive
- Modifications: What is allowed and not allowed
- Restrictions: Geography and/or Industry
- Violation of Terms: Consequences of any contract violations
The agreement protects us both and helps us to sleep better at night.
Exclusive & Non-exclusive — What’s the difference?
- Exclusive: Only you can use it for a specific purpose–higher cost.
- Non-Exclusive: Available to multiple brands/companies–more affordable.
Note: In both exclusive and non-exclusive art licensing, Tina Thaw will still own the copyright of the art/intellectual property.
Royalties? Flat Fees? Please explain.
- Royalties: I earn a percentage of sales. (Great options if you expect big profits.)
- Flat Fee: One-time payment upfront. (This option is simple and predictable.)
Can I buy your artwork outright?
You sure can! That is called a buyout or full transfer of rights. This is the most expensive option since I am giving up all future potential earnings from that piece of art.
Can I modify your artwork after licensing it?
Usually, no, and only minor changes with my approval. This is usually determined before signing the agreement.
Do I have to credit you when I license your art?
Some licenses I issue will require credit, while others do not. We will decide this together, and it will be outlined in our licensing agreement.
What if someone uses your art without a license?
This is called copyright infringement, and it is illegal. If I discover unauthorized use of my art or intellectual property, I will take legal action, which will include cease and desist letters, legal fees, and other no-so-fun consequences for the infringer.
How much does art licensing cost?
Pricing depends on factors like:
- Usage
- Exclusivity
- Duration
- Scope of Your Project/Launch
How long does an art license last?
Generally, I offer art licenses for 1, 2, and 3-year periods. However, we can discuss any other needs your situation may require, especially if your use is within your business branding.
Can I renew my license?
Absolutely! If your product is doing well and thriving, all that is needed is to review and renew together. We will revisit the original terms to make sure everything is still working for both of us. Yay!
Do you offer custom artwork for licensing?
